Whereas Criminal Law deals with the Government, either State or Federal, versus an individually accused citizen, the primary purpose of Civil Law is to resolve disputes and provide compensation for someone injured by someone else’s acts or behavior. These disputes are created from various issues, but Civil Law covers many areas of law, such as contracts, torts, and family law. Please refer to our other tab for information on Causey & Ye Law’s family law practice. We are quite good and experienced in family law, but here, we will focus on the other areas of Civil Law.
Often people think of Civil Law in terms of suing someone. While suing another private citizen or business entity can be a part of a Civil Law case, Civil Law as a whole is far more complicated than that. Below, we discuss each area of Civil Law where Causey & Ye Law defend and protect the rights of Iowans and others throughout the world.
Tort Law is a branch of Civil Law that is concerned with personal injury and civil wrongdoing. A tort is a civil wrong, done by one person or entity to another which results in injury or property damage. Frequently, it involves monetary compensation to the injured party. This is what is referred to commonly as “suing” another person or entity.
Many firms avoid trial at all cost. They prefer to settle, collect their fees, and move on, regardless of whether this hurts their clients. Causey & Ye Law has no problem taking someone or something, i.e. a Corporation or other business entity, to trial to get the compensation our clients deserve. The balance is cost versus compensation. Tort disputes often have little to do with fault. The person or entity at fault often does not even dispute s/he or it was at fault. Regardless of the situation, Causey & Ye Law will fight to get you every penny our clients deserve while maintaining the necessary balance amongst all of our clients’ interests.
Contract Formation and Negotiation: It is often said that the best offense is a good defense. This certainly holds true when entering into a contractual relationship. Often people just breeze over the details of a document that they sign and that binds them to act and perform in certain ways for long after they sign it. This is a bad idea.
Causey & Ye Law stresses allowing us to analyze the facts surrounding a contract, to negotiate the best position for you, and to draft the best contract for you and the situation before you ever sign anything. Causey & Ye Law charge very little for these services compared to most firms, and it is always better to pay a little bit, in the beginning, to make certain things are done right instead of paying a whole lot afterward when you find out things were done wrong. Causey & Ye Law has helped negotiate and form contracts for clients who are purchasing property, purchasing businesses, forming businesses, and more.
Causey & Ye Law is also adept at contract formation and negotiation on an international level. With our partner firm in China, Causey & Ye Law can assist clients who need contracts that reflect the American, Chinese, and International law. These are more complicated contracts and negotiations because they involve both contract law and immigration law. Causey & Ye Law is a very unique firm that understands all areas of law involved and can handle both ends of the deal.
Contract Disputes: The legal community in Iowa and abroad are discovering quickly that Causey & Ye Law have no problem going to trial to defend and protect our clients’ rights. However, often contractual disputes can be handled outside of the courtroom with much greater efficiency and at a lower cost. There is something about an attorney writing a letter or making a phone call that really will get the ball rolling in negotiating a resolution to a dispute between people or entities.
Causey & Ye Law is built on the resolution. Causey & Ye Law will calmly, efficiently, and judicially negotiate on our clients’ behalf. Litigation is always the ultimate trump card, but if Causey & Ye Law can negotiate a satisfactory, suitable, and fair settlement outside of court at a lesser cost to our clients, then we are happy to do so.
